A Faribault man was sentenced to 94 months in prison in relation to a 2018 overdose death of another Faribault man.  31-year-old Anthoney Michael Fugalli pled guilty on March 24th to "second-degree sale of controlled substances". Fugalli's plea also ended a nearly four-year-old case that was delayed by the pandemic and another case that went to the Minnesota Supreme Court. The 94-month sentence is an upward departure for the drug conviction.

According to a news release from Rice County, the 94-month sentence is the equivalent of a 3rd-degree murder charge. Fugalli plead guilty to the death of Jason Madow, of Faribault whom Fugalli admitted to law enforcement that he sold heroin tainted with the powerful opioid, fentanyl, to Madow in the early evening hours of June 18, 2018. Madow was then found dead of an overdose just before noon the following day, June 19, 2018.

Fentanyl is 80 to 100 times stronger than morphine, according to the U.S. Drug Enforcement Administration.

Fugalli was already serving a 78-month sentence for first-degree sale for twice selling heroin to undercover agents. After pleading guilty in that case, Fugalli tried to have his plea deal nullified, arguing that while he agreed to sell the10 grams required for the first-degree charge, he actually sold less than that. His argument was denied by the district and appellate courts, and again at the Minnesota Supreme Court, where justices pointed out that in state statute agreeing to sell 10 grams or more is the same as delivering 10 grams or more.

"This plea agreement extends Fugalli’s time in prison, and recognizes the harm he caused to the community.” Rice County Attorney John Fossum said. “By accepting responsibility and admitting his conduct, Fugalli helps the community recover from the damage he has caused, in addition, the upward departure provides the accountability of a longer-term in prison” Fossum added.

According to the Minnesota Department of Corrections website, Fugalli is currently incarcerated in Stillwater and was expected to be released on 09/11/2023.
